Customer: Anyone purchasing goods from PMSA (‘You’/‘Your’).
Registering for an account
– To be able to place an order through philippinemermaidswimmingacademy.com, You are required to register and create an online account. We ask You to provide valid and up-to-date personal information, for example Your name and phone number.
– You are responsible for ensuring that Your password and account login details are kept secret, safe and secure. We will not be held responsible or liable for any misuse of Your account should a third party gain access.
Products
– Photos of products on Our website are guidelines only and true colors, design, styles or detail may vary slightly from product to product for various reasons.
– It is Your, the customer’s, responsibility to submit accurate sizing measurements – a detailed list of measurements and measuring charts is available for reference.
– Products from philippinemermaidswimmingacademy.com are made from high quality materials and are skin safe, however We will not be held liable for any rashes, allergies or any illness or injury that may come about from using Our products.
Placing an order
– Products placed on philippinemermaidswimmingacademy.com are a non-binding invitation to You to buy goods.
– These Conditions of Sale come into force on the date You place your order through the website (after entering Your information and clicking the ‘order’, You make a contractual agreement to conclude a sales contract).
– By placing an order through philippinemermaidswimmingacademy.com, or by registering to purchase philippinemermaidswimmingacademy.com products, you guarantee that you are a legitimate customer and that you accept to be bound by these Conditions of Sale.
– The confirmation of receipt sent via email from Us, to You, verifies the acceptance of the offer and completes the contract of sale.

Minors under 18 cannot lawfully enter into a binding contract; they must seek the assistance of a parent or guardian to place an order on their behalf. Any orders placed by a minor shall be deemed null and void by Us.
– All orders placed through philippinemermaidswimmingacademy.com are subject to availability and We reserve the right to limit, change or amend the range of products offered and to limit the quantity of items that may be purchased from time to time and at any time, without prior notice.
Payment
– All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If Your card issuer refuses to authorize payment to philippinemermaidswimmingacademy.com, You will need to contact them directly to solve the issue. We will not be liable for delays or non-delivery in this case.
– Products remain the full property of philippinemermaidswimmingacademy.com until full payment is received by Us.
Delivery
– It is Your responsibility to provide Us with correct delivery details, We cannot be held liable for any items that are lost due to incorrect or unclear delivery details submitted by You, the customer.
– Please allow enough time for the delivery of your order – orders typically take 1 – 2 weeks, depending on Your location. Special delivery requests must be confirmed with Us in writing.
Returns and order cancellations
– Returns: We ensure our products leave the Factory in a completely saleable condition and We only accept returns in the case of damage in transit. If the product is damaged during shipping, we will seek compensation from the shipping company so we can fulfill your order.
– Cancellations: Once the order has been made by You via the website, any cancellations will automatically incur a 10% handling charge, plus any taxes and charges incurred as a result of refund.
– Upon receipt of Your product, You must carefully inspect the item for correctness, completeness and any possible damage from the shipping process.
– In the unlikely event of any damage or issues, concerns must be expressed to Us within three days of receipt of your shipment. After three days, we will not be responsible or liable for correcting any problems.
General
– Our products are not swimming or safety aids and should be used according to the recommendations, or at a registered Mermaid school. Children should be supervised by a parent or guardian at all times when using Our products. Only use products according to ability in the water, do not go our of your depth. As in all sporting activities, there may be risk of injury and PMSA will not assume any liability. When swimming as a Mermaid, you must always have a swimming ‘buddy’ present.
– PMSA reserves the right to refuse, cancel and terminate orders at any time, or if We deem these Terms and Conditions to have been contravened.
– PMSA has the right to modify the General Terms and Conditions at Our discretion, without prior notice, and continued use of the website on Your part will confirm your agreement to be bound by any modified conditions of sale. It is Your responsibility to regularly check the website to remain informed of any changes.
– PMSA will not assume liability for damage to the products from improper use, this includes lack of appropriate care for the items or not following the washing and storing guidelines.
